Congress enacted the Prison Rape Elimination Act in 2003 (PREA). The purposes of the Act are to establish a zero-tolerance policy regarding rape in prisons, jails, juvenile detention, and other confinement facilities by developing and implementing national standards for the detection, prevention, reduction, and punishment of Sexual abuse and/or Sexual Harassment. The Act also calls for an increase in the efficiency and effectiveness of state and local officials in investigating and prosecuting sexual abuse and/or sexual harassment while in confinement.
The Act applies to all public and private institutions that house adult or juvenile offenders and to community-based correctional agencies.
To comply with the Act, the Linn County Juvenile Detention Center (LCJDC) and Diversion Services are committed to:
LCJDC director will ensure all reports of sexual abuse and criminal sexual harassment are investigated promptly, thoroughly, and objectively for all allegations including third-party and anonymous reports. Reports of sexual abuse and criminal sexual harassment will be reported to the Linn County Sherriff’s Office for criminal investigation. All LCJDC staff shall cooperate with outside investigators and shall endeavor to remain informed about the progress of the investigation.
Where sexual abuse or criminal sexual harassment is alleged, Linn County Juvenile Detention Center shall use investigators from the Linn County Sheriff’s Office (319-892-6100) who have received special training in sexual abuse investigations involving juvenile victims.
